Sub : To prevent illegal counseling pattern being proposed by Selection Committee and Directorate of Medical Education – to conduct Counseling and provide seat allotment as per G.O. No 241 dated 29.10.2007 P & AR Department

As per the Government Order cited above

The Government also direct that the above 200 point roster shall be given effect from 15.9.2007 and the vacancies arising on and from the 15'September 2007 shall be filled up as per the 200 point roster and all selections for appointment shall be started afresh from serial number one of the 200 point roster with effect on and from the said date.

However in Page Number 14 of the Prospectus for “ADMISSION TO POST GRADUATE DIPLOMA / DEGREE / M.D.S / FIVE YEAR M.Ch. (NEURO-SURGERY) COURSES IN TAMIL NADU GOVERNMENT MEDICAL / DENTAL COLLEGES / SELF FINANCING AND GOVERNMENT AIDED INSTITUTIONS” for the year 2008 – 2009, it is given as

Roster method of rule of reservation will be followed if the seats are more than 1 and less than 8 in each branch as per G.O.Ms.No.241 dt.29-10-07 of P&AR (K) Dept. ofGovernment of Tamil Nadu. If the seats are 8 and more, the rule of reservation shallbe as follows:- Open Competition - 31%, Backward Class - 30%, Most Backward / Denotified - 20%, Scheduled Caste - 18%, Scheduled Tribe - 1%. Within the 30% reservation for Backward Classes 3.5% reservation will provided for BC Christians and 3.5% for BC Muslims.

Such a method of following two patterns of reservation in a single exam with a single counseling is totally illegal and is against the Orders of Government of Tamil Nadu and is in violation of the policies of the Government of Tamil Nadu. There is no rule under the Government of Tamil Nadu which advices for following one mode of reservation for few courses (where the seats are more than a certain number) and another mode of reservation for other courses (where the seats are less than a certain number)

The Orders of the Government clearly say that 200 point roster as prescribed in G.O. 241 dated 29.10.2007 P & AR Department is alone to be followed. Further TNPSC which appoints doctors for Tamil Nadu Medical Services follows the 200 point roster (31-24-3.5-3.5-20-18-1). The Director General of Health Services conducts counseling for 50% of Post Graduate Seats and the method is similar to the one followed by TNPSC, except that the percentage of reservation is in tune with the Central Government Rules (77.5-15-7.5)

Of the total Post Graduate seats in Tamil Nadu, only 25 % are given for Private Candidates and 25 % for Service Candidates and 50 % is filled by DGHS under All India Quota. As per the illegal method proposed by Selection Committee, Minorities (Muslims and Christians) are allotted a single seat only if are 28 seats in discipline. Thus there will be just 2 seats allotted to Minorities by Selection Committee among the 457 seats under the control of Selection Committee (out of total 914 seats) which is against the Government Order.

This is because of the Selection Committee following its own illegal and unethical method of reservation instead of the method instructed by the Government through GO No 241.

Because of the Illegal method proposed by the Selection Committee, the following hardships are encountered

1. Minorities get just 2 seats out of 457 instead of the 16 seats they will get if GO No 241 is followed instead of the Illegal method of Selection Committee

2. ST candidates are not getting any reservation in most courses

If the counseling and Seat allotment are made after making a “weighted merit list following G.O.241 dated 29.10.2007”, the above discrepancies will be corrected and 8 Muslims, 8 Christians and 5 ST candidates will be allotted.

Your good self have already mentioned this issue (mistakes committed by officials are hampering the policy of reservation and bringing bad name to the government) in your concluding remarks of the all party meet convened on 13-03-2008 for Reservation to Arundhatis. It is very unfortunate that, even after that, the Medical Post Graduation Selection Committee also is acting in its own illegal, unethical way and acting against the law of the land and violating the government policy and planning to conduct the counseling and seat allotment from 10th April 2008 with the wrong method there by going against the government norms and against the reservation policy of the government.

Hence we request your immediate intervention in directing the Selection Committee and Director of Medical Education to conduct the counseling and seat allotment as per GO No 241 (in the same way as done by TNPSC) by following the 200 point roster method by generating a weighted list ARRANGED IN THE ORDER IN WHICH APPOINTMENTS SHOULD BE MADE based on the Roster given in GO 241 and not by other illegal means
